Summary:Die Europäische Grenzschutzagentur Frontex ist zum Hauptadressaten für Kritik an der repressiven Ausrichtung der europäischen Flüchtlings- und Immigrationspolitik geworden. Die Kritiker scheint dabei die Überzeugung zu einen, dass sich über eine stärkere politische Kontrolle von Frontex die Entwicklung der Grenz- bzw. Immigrationspolitik in signifikanter Weise beeinflussen ließe. Als EU-Agentur gilt Frontex als ‚unpolitisch’, ihre Maßnahmen und Empfehlungen als ‚sachlich angemessen’. Im Beitrag wird argumentiert, dass dieser Status gegen Kritik doppelt abgesichert ist: Erstens institutionell über das Agenturmodell und dem damit verbundenen Expertenstatus und zweitens inhaltlich und strategisch über Risikoanalysen. Anhand einer Skizze der diesbezüglich relevanten Charakteristika der Institution und ihres modus operandi lässt sich zeigen, warum und unter welchen Umständen Kritik nicht anschlussfähig ist.
The European border management agency Frontex has become the main recipient of criticism regarding the EU’s repressive asylum and immigration policy. Here, critics seem to be convinced that the way to significantly influence the future development of the EU’s border control and immigration policy is to exercise tighter political control over Frontex. As an EU agency, Frontex is considered to be „apolitical” and its measures and recommendations are deemed to be „objective”. The argument put forward in this article is that this objective status of Frontex is effectively immune to criticism for two reasons: Firstly, because of its institutional design as an agency and its associated status as an expert; and secondly, because of its strong reliance on risk analysis as the basis for its operations. By highlighting some of the relevant characteristics of the agency and its modus operandi, it will be shown why and under which circumstances criticism falls short.
