| 520 | |a In diesem Beitrag werden Zusammenhänge zwischen Gesellschaftsstruktur und Strafjustizsystem aufgezeigt, wobei sich das Augenmerk speziell auf die Entwicklung in Deutschland seit Ende des 19. Jahrhunderts richtet. Es wird dargelegt, welche gesellschaftlichen Leitbilder die Strafrechtsmodelle der Moderne und Spätmoderne bestimmen, welche Ziele des Strafens verfolgt werden und welche Wirkungen realistischerweise erwartet werden können. Dabei orientiere ich mich an der traditionellen Unterscheidung des deutschen Strafrechts zwischen Tatstrafrecht und Täterstrafrecht sowie den moderneren Strafrechtsmodellen des Resozialisierungsstrafrechts und des kontrollierenden Präventions- oder Risikostrafrechts. Eine kurze Analyse der Strafrechtssysteme des Dritten Reichs und der Nachkriegszeit zeigt, dass das Täterstrafrecht in ganz unterschiedlicher Ausformung das Strafsystem bestimmen kann. Eine Auseinandersetzung mit aktuellen Tendenzen in Gesetzgebung und Sanktionspraxis führt vor Augen, dass das Risikostrafrecht mit seiner gesellschaftsschützenden Funktion das Sanktionensystem (Maßregeln, insbesondere Verwahrung) und die Strafgesetzgebung („symbolisches Strafrecht“) durchdringt. Das Strafrechtsmodell der Zukunft wird sich weg von einer konzisen, zweckorientierten Strafrechtstheorie verstärkt an einem eher vagen Strafkonzept orientieren, bei dem der Gedanke der Prävention durch Kontrolle und das pragmatische Krisenmanagement im Zentrum stehen. | ||
| 520 | |a Focusing on the evolution in Germany since the late 19th century, I will discuss the relationship between structures of modern society and systems of criminal justice: How penal practice is shaped by social institutions and concepts in modernity and late modernity, what kind of punishment is supposed to prevail and which relationship between the structure of society and criminal law one can reasonably expect. German criminal law traditionally distinguishes between a model focusing on the presuppositions for criminal liability as well as on the determination of the specific sentence on the offense („Tatstrafrecht”) and a model basing the sentence mainly on the offender’s personality („Täterstrafrecht”). Furthermore, we can differentiate between criminal justice models of social rehabilitation and of control and risk management. A brief overview of Germany’s criminal law during the Third Reich and the post-war era shows that the concept of „Täterstrafrecht” is multifaceted and can shape the criminal justice system in different ways. An analysis of current trends reveals that the criminal justice model of control and risk reduction increasingly permeates legislation, penal practice and sentencing. The criminal law of the future is likely to withdraw from a coherent purpose-based theory and to adhere to a rather vague concept of criminal law as an instrument for prevention by control and crisis management. | ||
