| Summary: | This study addressed the issue of releasing prisoners and not holding perpetrators of crimes accountable as one of the measures to end the conflict between the warring parties within the state. The study aimed to clarify the legal basis that permits these measures, the justifications that require them to be taken, the scope of the crimes they include, the restrictions that apply to them, their impact on achieving peace and justice, the mechanisms by which they are decided, and their legitimacy in view of international law due to their violation of human rights. The study followed the descriptive analytical approach to clarify the theoretical frameworks of the subject of our study. It reached a set of results, including that the measures taken by states during the period of armed conflicts, such as releasing prisoners and exempting perpetrators from punishment, are necessary in achieving reconciliation, establishing comprehensive peace among the members of society, and a democratic transformation characterized by stability, adequate security, and the rule of law. The process of releasing prisoners and not holding perpetrators accountable for their crimes committed during the period of armed conflict requires taking into account many basic rights, such as the right to know the truth and ensure that serious violations do not occur again in the future, and the right of the victim or his family to receive appropriate compensation for the harm that occurred to them. The study concluded with a number of recommendations. |
