Summary:The detention of members of organised criminal groups poses unique challenges to the prison system, with members frequently continuing their criminal activities, recruiting new members, and fighting rival groups in prison. International legal frameworks and regional prison standards provide almost no guidance to States on how best to address these issues. The purpose of this chapter is to identify the relevant challenges for the criminal justice system as well as to explore the (limited) international frameworks and case law setting out parameters for the detention of organised crime members.
