Zusammenfassung: | Since its founding in 1949, the use of capital punishment has played an important role in China’s criminal justice system (and political system, in some eras). China’s death penalty has evolved significantly over time, though its practice is always clouded with secrecy. This chapter reviews what we do and do not know about China’s practice and critically examines the gaps between China’s death penalty law and the practice. First, we review legislative changes to China’s death penalty laws and explain the existing system. Second, we focus on the significant role played by the Chinese judiciary (the Supreme People’s Court in particular) in promoting death penalty reform measures in the new century. Last, we examine what we know about the actual practices to identify the gaps between law in books and law in action. |
