| Zusammenfassung: | This study examines the role of psychological expert evidence in cases of child sexual abuse in the Basque Autonomous Community between 2019 and 2025. Based on the analysis of 54 court rulings, it explores how children's testimonies are assessed in criminal proceedings, considering variables such as age, gender, relationship with the accused, and duration of abuse. In the absence of other direct evidence, the child's testimony becomes the central element of the trial. Results show that most defendants are men and often have a close relationship with the victim. The analysis also reveals a high rate of repeated abuse and procedural limitations in the use of pre-constituted evidence. The paper emphasizes the need for specialized training and adapted protocols to ensure rigorous forensic assessment, protecting both the rights of minors and the procedural guarantees of the accused. Ultimately, it advocates for strengthening the multidisciplinary approach and improving technical and legal tools to achieve a more sensitive and effective justice system. Este estudio analiza el papel de la prueba pericial psicológica en casos de agresión sexual infantil en la Comunidad Autónoma del País Vasco entre 2019 y 2025. A partir del examen de 54 sentencias judiciales, se explora cómo se valora el testimonio de menores en el proceso penal, considerando variables como la edad, el género, la relación con el acusado y la duración del abuso. El testimonio infantil, en ausencia de otras pruebas directas, constituye el eje central del juicio. Los resultados evidencian que la mayoría de los acusados son hombres y que en muchos casos existe una relación cercana con la víctima. El análisis muestra además un alto porcentaje de delitos continuados, así como limitaciones en el uso adecuado de pruebas anticipadas. El trabajo destaca la necesidad de formación especializada y protocolos adaptados para garantizar una evaluación forense rigurosa, protegiendo tanto los derechos del menor como las garantías procesales del acusado.Finalmente, se aboga por fortalecer el enfoque multidisciplinar y por seguir perfeccionando los instrumentos técnicos y jurídicos para una justicia más sensible y efectiva. The objective of this paper is to understand and analyse the psychological expert evidence applied to the credibility of the testimonies of minors, more specifically, victims of child sexual aggression. Following a literature review and through an empirical review of judgments issued by the Provincial Courts of the Basque Autonomous Community (2019-2025), we examine the techniques for obtaining accounts, individual and external factors, as well as the influence of the quality of evidence in judicial proceedings. The results of the empirical study demonstrate that forensic discussions tend to focus on the child's testimony, and how the court's assessment focuses on different criteria. |
