Summary:This paper makes a detailed study of the precepts in which the Penal Code considers in a special way people with intellectual disabilities as victims of crime, limiting ourselves to the cases in which the victim is of legal age. Firstly, we will present the social model of disability and intellectual disability from which we start and, subsequently, these precepts will be analysed, emphasizing the different expressions that the legislator uses to refer to victims with intellectual disabilities in order to determine whether or not they refer to the same reality. Likewise, we will try to give content to these expressions and propose, if necesary, the appropriate lege lata and lege ferenda proposals.
En este trabajo se hace un estudio detenido de los preceptos en los cuales el Código Penal contempla de manera especial a las personas con discapacidad intelectual como víctimas del delito limitándonos a los supuestos en los cuales la víctima es mayor de edad. En un primer momento expondremos el modelo social de discapacidad y discapacidad intelectual del que partimos y, posteriormente, se analizarán dichos preceptos haciendo hincapié en las diferentes expresiones que utiliza el legislador para referirse a las víctimas con discapacidad intelectual, con el objetivo de determinar si se refieren o no a la misma realidad. Asimismo, se intentará dotar de contenido a dichas expresiones y plantear, en su caso, las propuestas de lege lata y lege ferenda oportunas.
