Zusammenfassung:Remote hearings have emerged as a transformative tool in India's criminal justice system, addressing issues of accessibility, efficiency, and fairness. The Supreme Court has issued guidelines standardizing video conferencing procedures across courts. The recent Bharatiya Nagarik Suraksha Sanhita, 2023 further supports electronic modes in legal proceedings. This study examines the impact of remote hearings on criminal proceedings in India, analysing their implementation and effectiveness across courts. It evaluates how video conferencing aligns with fair trial principles, including the right to be present, cross-examination, and witness examination. The research assesses advantages and challenges of remote hearings in terms of accessibility, efficiency, and cost- effectiveness. Additionally, the study investigates the potential of remote hearings to address case backlogs and expedite justice delivery in India's criminal justice system. Through this analysis, the research aims to provide insights into technology's role in modernizing court proceedings while maintaining judicial integrity. Remote hearings enable examination of witnesses, recording of evidence, and participation of accused persons, while maintaining fair trial principles. They offer advantages like increased accessibility, cost savings, and enhanced security for vulnerable participants. However, concerns remain regarding privacy, digital infrastructure access, and maintaining confidentiality in sensitive cases.
