| 520 | |a The basic goal of restorative justice (RJ), whose most well-known tool is penal mediation, is the meaningful reparation of the victim and the effective accountability of the offender. Although the 2012 Directive of the European Parliament and the Spanish Victim Statute (2015) established rules to ensure victims’ access to RJ services, its implementation in Spain is very limited, among other circumstances, due to the prohibition of using mediation in cases of gender-based violence (established by Organic Law 1/2004), which Organic Law 10/2022 has extended to cases of sexual violence. This article provides a critical review of the regulations and doctrines regarding the reasons for such prohibitions. We understand that there are three main explanatory hypotheses: A paternalistic view that limits the freedom and possibilities of reparation for victims, which is combined with a demonizing view of the offender as irredeemable; an erroneous conception of penal mediation understood as a lesser justice for minor cases ; and a homogenization of all cases of sexual violence classified as unforgivable. | ||
| 520 | |a El objetivo fundamental de la justicia restaurativa (JR), cuya herramienta más conocida es la mediación penal, es la reparación significativa de la víctima y la responsabilización efectiva del agresor. Aunque la Directiva del Parlamento Europeo de 2012 y el Estatuto de la Víctima (2015) establecieron normas para garantizar el acceso de las víctimas a servicios de JR, en España su implementación es muy limitada, entre otras circunstancias por la prohibición de utilizar la mediación en los casos de violencia de género (establecida por la L. O. 1/2004), que la L. O. 10/2022 ha ampliado a los casos de violencia sexual. En el presente artículo se hace una revisión crítica normativa y doctrinal de los argumentos de tales prohibiciones. Entendemos que son tres las principales hipótesis explicativas: Una visión paternalista de las víctimas, que limita su libertad y sus posibilidades de reparación, y demonizadora del agresor, entendido como irrecuperable; una concepción errónea de la mediación penal comprendida como justicia menor para casos leves; y una homogeneización de todos los supuestos de violencia sexual calificados como imperdonables. | ||
