| Summary: | En el trabajo se discute si las teorías del desistimiento y las implicaciones preventivas que derivan de ellas son universales o dependen de las características estructurales de cada contexto. Por descontado las teorías del desistimiento, al igual que las teorías criminológicas en general, identifican mecanismos socio-psicológicos que son relevantes en general para entender el comportamiento humano. Pero estos mecanismos causales son activados por determinados factores que pueden ser más o menos prevalentes según el contexto. De la misma manera, la efectividad de determinadas instituciones preventivas también puede depender de la existencia de determinadas condiciones estructurales. En el trabajo, pongo algunos ejemplos de esta dependenciaestructural de las teorías del desistimiento y de sus implicaciones prácticas y me detengo en analizar si algunas característicasestructurales de la sociedad española -como el familismo o el carácter inclusivo del sistema penitenciario -podrían explicar la importancia de la teoría del apoyo social para entender el desistimiento en nuestro contexto y el rol que cumple en ello el cumplimiento comunitario de la pena de prisión. The paper discusses whether theories of desistance and their preventive implications are universal or dependent on the structural characteristics of the context. Of course, theories of desistance, like criminological theories in general, identify social-psychologicalmechanisms that are generally relevant for understanding human behaviour. But these causal mechanisms are triggered by certain factors that may be more or less prevalent depending on the context. In the same way, the effectiveness of certain preventive institutions may also depend on the existence of certain structural conditions. In this paper, I give some examples of this structural dependence of theories of desistance and their practical implications, and I analyse whether some structural characteristics of Spanish society -such as familism or the inclusive nature of the prison system- could explain the importance of the theory of social support in understanding desistance in our context, and the role played by community service of the prison sentence. |
