Summary:South Africa is a fertile ground for the human trafficking crime due to the propensity of southward migration flows, porous borders and coastlines, fragile structures and institutions, serious rates of poverty, and persistent gender inequalities. However, the jurisdiction is currently one of the few nations in Africa that have actively engaged in combating the crime. South Africa has adopted specific and comprehensive anti-trafficking legislation, namely the Prevention and Combating of Trafficking in Persons Act 7 of 2013, essentially based on the UN Protocol of 2000. Before the implementation of this Act on 9 August 2015, the crime of human trafficking was penalised in a fragmented manner by means of diverse common-law crimes such as assault, rape, murder, abduction, kidnapping, and also statutory crimes such as racketeering, money laundering. The introduction of the new all-inclusive legislation covers all aspects of human trafficking by protecting vulnerable persons and victims of trafficking; by preventing the crime by means of awareness raising and reducing the demand, and by punishing traffickers in a commensurate manner. This chapter explores the above-mentioned aspects; elucidate on the root causes and particular types of trafficking as well as the flow patterns of human trafficking in this particular region.
