To answer the question, the research used the case study of the situation of lack of oxygen in Manaus - AM and used the qualitative approach and the descriptive - analytical method. It was found that the Brazilian State, due to the constitutional duty to guarantee health, must appear as an active subject and be criminally liable with the incidence of a fine. | ||

O problema sobre o qual a pesquisa se debruçou apresenta-se na forma de pergunta: diante da configuração da mistanásia quem deveria figurar como sujeito ativo e ser responsabilizado criminalmente? Para responder ao questionamento, a pesquisa valeu-se do estudo de caso da situação de falta de oxigênio em Manaus –AM e utilizou-se da abordagem qualitativa e do método descritivo –analítico. Constatou--se que o Estado Brasileiro, em razão do dever constitucional de garantir saúde, deve figurar como sujeito ativo e ser responsabilizado criminalmente com a incidência da pena de multa. | ||
