| 520 | |a This article intends to reflect upon the current practice of torture in Brazil, notably on its use as an instrument to obtain confessions that are later taken to the judicial proceedings and valued as evidence giving rise to manifestly unfair convictions. Still, the objective is to list some measures that can be envisioned as corrective mechanisms against the culture of impunity and systematic use of torture. For that, it makes use of a wide systematic review of the bibliography on the subject, including international conventions, normative acts and reports produced by authoritative institutions. In addition, a case study will be carried out on a rumored trial that culminated in the conviction of seven innocent people for an alleged crime committed in the context of a satanic ritual in the city of Guaratuba, on the Paraná coast, in the 1990s. The focus will be the use of torture during the police investigations of the so-called "Evandro Case". In light of the aforementioned case, the research problem is precisely to verify to what extent torture still persists as an institutional practice of police apparatus in Brazil. The hypothesis that guides the work is that, even today, torture is used because there is impunity and the illicit evidence derived from it continues to be valued for unjust convictions. | ||
| 520 | |a Este artigo pretende refletir sobre a atualidade da prática da tortura no Brasil, notadamente sobre o seu uso como instrumento para a obtenção de confissões que, posteriormente, são levadas aos processos judiciais e valoradas como provas que dão azo a condenações manifestamente injustas. Ainda, objetiva-se elencar algumas medidas que podem ser vislumbradas como mecanismos de correção contra a cultura de impunidade e uso sistemático da tortura. Para tanto, vale-se de ampla revisão sistemática da bibliografia sobre o tema, incluindo convenções internacionais, atos normativos e relatórios produzidos por instituições abalizadas. Além disso, será feito estudo de caso sobre rumoroso julgamento que culminou na condenação de sete pessoas inocentes por suposto crime praticado em contexto de ritual satânico na cidade de Guaratuba, litoral do Paraná, na década de 1990. O foco será, especialmente, o uso da tortura durante as investigações policiais do denominado “Caso Evandro”. À luz do referido caso, o problema de pesquisa é, justamente, verificar em que medida ainda persiste a tortura como prática institucional dos aparatos policiais no Brasil. A hipótese que norteia o trabalho é que, ainda hoje, a tortura é empregada porque há impunidade e as provas ilícitas dela derivadas continuam a ser valoradas para condenações injustas. | ||
