Zusammenfassung:This article highlights the unconventionality of article 53 paragraph e of the Law 137 of 1994 that regulates disciplinary procedures. According to this provision, in cases where public servants breach their functional duties during states of emergency, the appeal of a conviction that restrict political rights is granted in the return effect. Enforcing disciplinary sanctions without first resolving the appeal is contrary to the right to double conformity and to the principle of intangibility, established in articles 8.2 paragraph h and 27.2 of the American Convention on Human Rights. This articles also proposes solutions to overcome this irregularity.
Aquí se muestra la inconvencionalidad del literal e del artículo 53 de la Ley 137 de 1994, por el cual en los procesos disciplinarios tramitados por incumplir los deberes funcionales previstos en la legalidad de excepción se concede en el efecto devolutivo la apelación del fallo sancionatorio de primera instancia que restringe los derechos políticos. Ejecutar las sanciones disciplinarias sin que antes el superior resuelva los argumentos resulta contrario a la doble conformidad y al principio de intangibilidad, previstos en los artículos 8.2 literal h y 27.2 de la Convención Americana sobre Derechos Humanos. Se plantean soluciones para superar esta irregularidad.
