|a O trabalho aborda o tema do sistema de justiça criminal do ponto de vista de sua seletividade sobre os indivíduos. É importante utilizar a lógica punitiva moderna para compreender o funcionamento seletivo do sistema penal moderno. Discute as origens do modelo de política criminal para confrontar as funções declaradas desse sistema, tais como a ressocialização, com as suas funções reais, como a estigmatização. Procura desconstruir o mito do direito penal igualitário, que contempla a todos indistintamente da sua pertença a um estrato social determinado, ou às características étnicas. Adotou-se como marco teórico do trabalho a criminologia crítica, mediante pesquisa bibliográfica sobre política criminal e o funcionamento do sistema penal moderno, que demonstra que a seletividade existe, porque o Estado firmado na defesa social se excede no tratamento punitivo para aqueles advindos dos estratos sociais mais baixos, tratando de forma discriminatória os que pertencem a essa classe social, diferentemente daqueles que cometem crime de colarinho branco.This paper addresses the issue of criminal justice system from the point of view of its selectivity over individuals. It is important to use the modern punitive logic to understand the operation of the selective modern penal system. The work discusses the origins of the model criminal policy to confront functions declared of that system, such as ressocialization, with their actual functions such as stigmatization. It attempts to deconstruct the myth of egalitarian penal law, which includes all indifferently of their belonging to a particular social stratum, or ethnic characteristics. It was adopted as theoretical framework for this critical criminology, bibliographic research on criminal policy and modern penal system functioning, where one sought the fundaments of this paper in order to show that selectivity exists in practice, in which the State signed in social defense is exceeded in punitive treatment for those coming from lower social classes and treats selectively for those who belong to those classes.
