| Zusammenfassung: | The present article aims to study crimes against humanity from a phenomenological perspective, which refers to a philosophical movement that looks for the defining essence of social concepts and phenomena. In this regard, we expose some theories which have addressed the characteristics that singularize crimes against humanity, or, in other words, that differentiate them from any other legal or extralegal notion which may seem indistinguishable from them. In order to achieve this outcome, this work is divided into three parts. Firstly, we draft a brief history of crimes-against-humanity terminology and corresponding rules, not only because an analysis of these criminal norms requires knowing the various international instruments which address them, but also because a philosophical investigation about the meanings conferred to this concept may get inspiration from an inquiry about how it has been used over time. Secondly, we examine the legal content of crimes against humanity, enumerating their normative elements according to the relevant internacional treaties and international tribunals’ jurisprudence. Thirdly and lastly, we deal with the phenomenological approach to the abovementioned crimes, which is the purpose of this article. O presente artigo visa a estudar os crimes contra a humanidade à luz de uma perspectiva fenomenológica, subárea da filosofia que busca a essência definidora de conceitos e de fenômenos sociais. Nesse sentido, apresentar-se-ão algumas das teorias que têm se dedicado a apontar quais são as características que singularizam os crimes contra a humanidade, isto é, que os diferenciam de qualquer outra noção, jurídica ou extrajurídica, que com eles possa confundir-se. Para tanto, este trabalho é dividido em três partes. Na primeira, esboça-se um histórico da terminologia e das normas referentes aos crimes contra a humanidade, não só porque uma análise jurídica desses tipos delitivos exige que se conheçam os vários instrumentos internacionais em que estão inscritos, mas também porque uma investigação filosófica dos sentidos atribuídos a esse conceito pode extrair inspiração de um relato de como ele tem sido usada ao longo do tempo. Na segunda parte, aborda-se o conteúdo técnico-jurídico dos crimes contra a humanidade, enumerando-se seus elementos normativos, conforme as convenções internacionais pertinentes e a jurisprudência dos tribunais internacionais. A terceira e última parte lida com o estudo fenomenológico dos crimes mencionados, que é o objetivo deste artigo. |
