Summary:O presente artigo busca investigar como a ideologia, enquanto mecanismo garantidor da reprodução das relações sociais vigentes, atua na complexa interação entre o sistema punitivo e as demandas do mercado capitalista. A análise parte da delimitação do conceito de ideologia, passando por uma breve explanação acerca do surgimento do Direito Penal moderno, atrelado às exigências do capitalismo em desenvolvimento e pela conformação da pena segundo o conceito de retribuição equivalente. Por fim, discute-se a relação entre o Direito Penal e o capitalismo globalizado nos dias atuais, caracterizada pelo inchaço do sistema punitivo concomitante à supressão do Estado social, e pela crença no punitivismo como resposta a profundos problemas sociais, por meio da ideologia, mantendo a situação de desigualdade das relações sociais vigentes.
This article seeks to explore how ideology, as a guaranteeing mechanism for the reproduction of current social relations, influences the complex interaction between the punitive system and the demands of the capitalist system. The analysis starts from the delimitation of the concept of ideology, passing by a brief explanation about the emergence of modern Criminal Law, linked to the demands of developing capitalism and the conformation of the penalty according to the concept of equivalent retribution. Finally, it discusses the relationship between Criminal Law and globalized capitalism today, characterized by the swelling of the punitive system concomitant the suppression of welfare state, and by the belief in punitiveness as a response to deep social problems, through ideology, maintaining unequal social relations.
