Summary:Compliance programmes, according to the most common definition, are a management tool for organisations that serve to prevent, detect and internally sanction behaviour that is contrary to the normative commitments that the organisation has assumed, whether they come from the legal system or are assumed voluntarily by the entity. Restorative justice, on the other hand, is a methodology for resolving conflicts caused by unlawful behaviour, with the aim of restoring the situation through a dialogue procedure, governed by a set of values (protagonism, recognition, restoration, accountability). However, compliance programmes are indispensable for resolving social conflicts arising from corporate violence, when there is damage resulting from unlawful behaviour. At the same time, it can also be seen how the design of compliance programmes according to restorative values allows them to be more efficient in their task: to get the members of the organisation to respect the rules.
Los programas de cumplimiento, según la definición más usual, conforman una herramienta de gestión de organizaciones que sirven para prevenir, detectar y sancionar internamente comportamientos contrarios a sus compromisos normativos ya procedan del ordenamiento jurídico o hayan sido asumidos voluntariamente por la entidad. La justicia restaurativa, por su parte, es una metodología para resolver conflictos ocasionados por un comportamiento ilícito, con el fin de recomponer la situación a través de un procedimiento dialogado, presidido por un conjunto de valores (protagonizar, reconocer, restaurar, responsabilizar). Atendiendo a este objetivo, los programas de cumplimiento resultan imprescindibles para resolver los conflictos sociales que se derivan de la violencia corporativa, cuando existen daños derivados de comportamientos ilícitos. A su vez, también puede constatarse cómo la confección de programas de cumplimiento conforme a valores restaurativos les permite ser más eficientes en su tarea: conseguir que los miembros de la organización respeten las normas.
