Summary:One of the fundamental rights of the person, by the mere fact of being one, is the non-discrimination based on birth, race, sex, religion, opinion or any other personal or social condition or circumstance. In our legal system, the main instrument for the fight against discrimination for racist, ideological, and religious motives is constituted by article 510 of the Penal Code, modified by L. O. 1/2015, of March 30. This study analyzes the compatibility of art. 510 with the Framework Decision 2008/913 / JAI of the Council of November 28, 2008 and the doctrine of the Constitutional Court, as well as the application of the aforementioned crimes by the Jurisprudence.
