Die Kommission, die vor allem mit der Aufklärung und Untersuchung von Menschenrechtsverletzungen unter dem Apartheidsregime beauftragt ist, gliedert sich in drei Ausschüsse: Human Rights Committee, Amnesty Committee und Committee for Compensation and Rehabilitation. Im Vergleich mit der Rechtspraxis anderer Länder stellt die Amnestieregelung in Südafrika eine Neuerung dar: der Amnestieausschuß hat vollkommen unabhängig, ohne rechtliche Vorgaben und unanfechtbar über Amnestiegesuche zu entscheiden.
