AB Der Aufsatz unterstreicht die Bedeutung der Erforschung der strafrechtlichen Normgenese für die wissenschaftliche Analyse von Kriminalität und Kriminalitätskontrolle in der Spätmoderne. Es wird eine Bilanz der wichtigsten Novellierungen des belgischen Strafrechts während der Regierungen Verhofstadt I (1999 – 2003) und Verhofstadt II (2003-2007) vorgeführt. Schließlich wird ein kritischer theoretischer Bezugsrahmen für eine struktur-historische Analyse der strafrechtlichen Transformationen in der Spätmoderne erarbeitet.
AB This contribution underlines the importance of the study of the penal lawmaking process for a scientific analysis of crime and crime control in late modernity. An inventory of the important changes of the Belgian penal laws during the governments Verhofstadt I (1999-2003) and Verhofstadt II (2003-2007) has made. A critical theoretical framework for a structuralhistorical analysis of the transformation of the penal law in late modernity is elaborated.
