AB Vertreterinnen und Vertreter der neurowissenschaftlich argumentierenden Kriminalbiologie greifen das Strafrecht häufig mit dem Argument an, es sei Erfüllungsgehilfe der Volkspsychologie. Der Beitrag wendet diesen Begriff kritisch gegen die Neurokriminologie selbst und zwar in drei Hinsichten: Zum einen wird geltend gemacht, dass die neue Kriminalbiologie am Volksglauben des bösartigen Individuums partizipiert. Zweitens wird gezeigt, dass die spezifische Version dieses Glaubens anhand der volkstümlichen Annahme entwickelt wird, dass sich jemand abweichend verhält, wenn er im Kopf nicht ganz richtig ist. Drittens wird mit Blick auf neuere Forschungen der Nachweis geführt, dass ätiologische Aussagen über den Zusammenhang von neuronalen Dysfunktionen und Psychopathie auf manifest volkspsychologischen Unterscheidungen beruhen.
AB Exponents of the neuroscientifically arguing criminal-biology frequently impute criminal law being an accomplice of folk psychology. The article critically turns this term against neurocriminology itself namely in three regards: In the first place it asserts that the new criminal-biology participates in the popular belief of the wicked individual. Secondly it holds that the specific version of this belief is based on the popular assumption that deviant behaviour results from being touched in the head. With a view of recent research it thirdly proves that etiological statements on the coherence of neural dysfunctions and psychopathy are manifestly based on folk psychological features.
