Summary:A person who has died while being held in custody by the police or by the court system is referred to as a ‘custodial death.’ Time and again, a claim of torture is found to be connected with the occurrence of unexpected death in prison. These kinds of deaths attract an inordinate amount of scrutiny from the general public and the media, as well as the witness testimony of torture provided by the family to the legal department. The purpose of this paper is to investigate the pattern and cause of death in cases of custodial torture, as well as to provide an overview of the legislation passed by the Parliament in Pakistan, keeping in view the International Law.
