Description
Summary:Court procedures are governed by procedural laws, which stipulate procedural norms for initiating and initiating lawsuits in a manner that ensures parties' rights. Consequently, the parties must adhere to these procedures to ensure the trial's seriousness and its proceedings. To guarantee the proper conduct of a lawsuit, the legislator often imposes procedural sanctions, including dismissal of the case if parties are absent from court sessions. Such dismissal can have negative effects or impact on the parties' rights. Thus, it is considered a procedural matter that may result in practical problems affecting the disputing parties' rights, necessitating a study of the legal framework regarding dismissal as a procedural sanction. This involves examining the stance of the Jordanian legislator on the matter, how it is regulated, its impact on the parties' rights, and providing necessary recommendations to address the consequences. The researcher discusses this in two parts: the first addresses the instances of dismissal, while the second examines the ensuing effects. Finally, results and recommendations are presented to mitigate the negative impact that may arise from dismissal.
