| Summary: | This study examines the complex challenges of copyright law enforcement in contemporary digital platforms, particularly focusing on unauthorized content distribution through social media applications such as Telegram, TikTok, and X. The research employs a normative jurisprudential methodology, analysing the implementation and effectiveness of Act No. 28 of 2014 concerning Copyright (UUHC) in Indonesia's digital landscape. The study reveals significant disparities in copyright enforcement capabilities across different social media platforms, with Telegram presenting unique challenges due to its enhanced privacy features and encryption protocols. The findings identify four interconnected weaknesses in current copyright enforcement systems: technical limitations in digital infrastructure, coordination challenges between enforcement agencies, human resource constraints, and regulatory frameworks ill-suited for modern digital environments. In response, this research proposes a novel integrated framework comprising four key innovations: smart technology integration, unified command structure, enhanced capability development, and modern regulatory frameworks. The study concludes that effective copyright protection in the digital age requires a paradigm shift from reactive enforcement to proactive prevention, necessitating continuous adaptation of legal frameworks, enhanced international cooperation, and greater collaboration between platform providers, rights holders, and enforcement agencies. This research contributes to the existing literature by providing a comprehensive analysis of contemporary copyright enforcement challenges and proposing practical solutions for addressing these challenges in the evolving digital media landscape. |
