This failure to reform dovetails with internal pressures for private policing mechanisms within organizations, resulting in corporate criminal justice that is selective, sometimes instrumental, arbitrary, and sometimes deserved, but rarely proportional, consistent, and equally applied. Where does that leave the “corporate offender”? This chapter argues that a return to “first order” principles are needed and suggests “constructive fault” as a possible starting point and suggests possible ramifications of this approach.
