RT Article T1 The death penalty in the Peoples Republic of China JF The Elgar companion to capital punishment and society SP 262 OP 277 A1 Liang, Bin 1972- A1 Wang, Jinzhou A2 Wang, Jinzhou LA English YR 2024 UL https://krimdok.uni-tuebingen.de/Record/1936244349 AB Since its founding in 1949, the use of capital punishment has played an important role in China’s criminal justice system (and political system, in some eras). China’s death penalty has evolved significantly over time, though its practice is always clouded with secrecy. This chapter reviews what we do and do not know about China’s practice and critically examines the gaps between China’s death penalty law and the practice. First, we review legislative changes to China’s death penalty laws and explain the existing system. Second, we focus on the significant role played by the Chinese judiciary (the Supreme People’s Court in particular) in promoting death penalty reform measures in the new century. Last, we examine what we know about the actual practices to identify the gaps between law in books and law in action.
