The odds are generally stacked against capital defendants, and beating those odds requires a specialized set of skills, knowledge, and experience that the average criminal defense attorney simply does not possess. Good capital defense work can make or break a case, often functioning as the difference between life and death. It should come as little surprise, then, that those who identify as capital defenders make up an elite and dedicated community. Yet, the work also comes with a heavy toll. In this chapter, we survey the limited body of scholarly literature on the roles and challenges faced by capital defense attorneys in the US, drawing upon parallels in other fields and highlighting the complexities of the profession as uncovered in our own study of capital defenders.
