The exegesis of this criminal offence brought to light, among other challenges, the complexities involved in identifying a legal interest of sufficient significance to warrant protection under Criminal Law. As a consequence, a considerable portion of the academic literature in the field has rightly questioned the need for its criminal categorisation. However, adherence to the principle of validity compels the interpreter to explore and, as far as possible, define a specific scope for the offence of leaving the scene of an accident. This study offers a critical analysis of the insights provided by existing literature and case law on this offence and proposes a potential interpretation of the protected legal interest and some key elements associated with this criminal offence. | ||
| 520 | |a Tras una tenaz y fructífera presión social, la LO 2/2019, de 1 de marzo, introdujo en el art. 382 bis del vigente Código penal español el delito de abandono del lugar del accidente, reformado posteriormente por la LO 11/2022, de 13 de septiembre. La exégesis de esta figura delictiva ha revelado, entre otros problemas, las dificultades para precisar un bien jurídico con entidad suficiente para ser protegido por el Derecho penal, lo que ha conducido a buena parte de la doctrina, con razón, a cuestionar la necesidad de su tipificación penal. No obstante, el principio de vigencia obliga al intérprete a buscar y, en la medida de los posible, encontrar un ámbito de aplicación propio al delito de abandono del lugar del accidente. En este estudio se realiza un análisis crítico de las contribuciones que hasta la fecha han ofrecido doctrina y jurisprudencia sobre este delito, a la vez que se presenta una posible interpretación acerca del objeto de protección y de algunos de los elementos fundamentales de esta figura delictiva. | ||
