AB En el ámbito del proceso penal, la evolución de enfoques y técnicas alternativas ha dado lugar a un debate enriquecedor, pero que en ocasiones resulta confuso. En concreto, la justicia restaurativa y su definición poco clara, a menudo ha sido asimilada o confundida con la mediación penal, ensalzando esta como única alternativa al proceso. En el contexto español, la adopción y comprensión de técnicas restaurativas ha generado cierta ambigüedad y confusión terminológica. En el presente artículo, exploramos la naturaleza de la justicia restaurativa y la mediación penal, analizando la posibilidad de que converjan, así como sus diferencias clave, y examinamos cómo encajan en el sistema jurídico de España a la luz de su marco legal.
AB Within criminal proceedings, the development of alternative approaches and techniques has given rise to an enriching but sometimes confusing debate. In particular, restorative justice and its unclear definition has often been assimilated or confused with criminal mediation, praising the latter as the only alternative to prosecution. In the Spanish context, the implementation and understanding of restorative techniques has generated some ambiguity and terminological confusion. In this article, the nature of restorative justice and criminal mediation is explored, analyzing their possible overlap and their key differences, and examining how they fit into Spain’s legal system in terms of its legal framework.
