Angesichts erheblich gestiegener Anordnungen und einer Verlängerung der durchschnittlichen Aufenthaltsdauer war es das Ziel, durch eine restriktivere Ausgestaltung der Anordnungsvoraussetzungen die Anstalten zu entlasten. Die Anstalten waren auch damit überlastet, dass häufiger Personen untergebracht wurden, die mit den vorhandenen Therapieansätzen nicht erreicht werden konnten. Nach den ersten Erfahrungen in der Praxis gehen die Anordnungen zurück, die Reform scheint ein Erfolg. Allerdings wird nunmehr der Strafvollzug mit den zuvor in den Entziehungsanstalten Untergebrachten belastet, was ein großes Problem darstellt, weil die Ressourcen für Suchtbehandlungen weitgehend nicht vorhanden sind und damit die Gefahr droht, dass der Kreislauf von Sucht, Kriminalität, Strafvollzug und Rückfall sich ungebremst fortsetzt. Deshalb bedarf es nach Ansicht der Autoren eines Gesamtkonzepts der Suchtbehandlung im Strafvollzug mit der Verzahnung mit entsprechenden ambulanten Suchtbehandlungseinrichtungen bzw. Nachsorgemaßnahmen. Die Verfasser plädieren für die Abschaffung des § 64 StGB, allerdings unter Aufrechterhaltung der positiven therapeutischen Strukturen der Entziehungsanstalten, die dem Strafvollzug zugeordnet werden sollen. | ||
| 520 | |a The placement of offenders under Section 64 of the German Criminal Code (StGB) in a closed facility for alcohol and drug addicts was the subject of the reform of the law on sanctions with the Act of 1 October, 2023. In view of the significant increase in placement orders and an increase in the average length of stay, the aim was to relieve the burden on institutions by making the conditions for orders more restrictive. The alcohol and drug treatment institutions were also overburdened by the fact that more people were being accommodated who could not be reached with the existing therapeutic approaches. Based on initial practical experience, the number of orders has decreased and the reform appears to have been a success. However, the prison system is now burdened with those previously placed in rehabilitation facilities. This is a major problem because in general the resources are not available for addiction treatment in regular prisons. There is therefore a risk that the cycle of addiction, crime, imprisonment and recidivism will continue unchecked. The authors therefore believe that an overall concept of addiction treatment in the prison system is needed. This should be linked to appropriate outpatient addiction treatment facilities and aftercare measures. The authors plea for abolishing the placement of offenders according to Section 64 CC, but propose to keep the positive therapeutic treatment facilities, which should be relocated to the prison administration. | ||
