AB Am 1. Oktober 2023 sind im Rahmen einer umfangreichen Überarbeitung des Sanktionenrechts die Neuregelungen der Unterbringung in der Entziehungsanstalt nach § 64 StGB in Kraft getreten (BGBl. I 2023, 203). Der Beitrag möchte durch eine Analyse höchstrichterlicher Rechtsprechung zu den neu gefassten Anordnungsvoraussetzungen des § 64 StGB und die Ergebnisse einer ersten bundesweiten Befragung von Einrichtungen, in denen § 64 StGB vollzogen wird, erste Entwicklungstendenzen und Erfahrungen mit den Neuregelungen berichten.
AB On October 1, 2023, as part of a comprehensive revision of the law on sanctions, the new regulations on placement in a detention facility in accordance with § 64 StGB came into force (BGBl. I 2023, 203). This article aims to report on initial trends and experiences with the new regulations by analyzing supreme court rulings on the revised requirements for ordering placement under § 64 StGB and the results of an initial nationwide survey of facilities in which § 64 StGB is enforced.
