Solutions oscillate between justice approaches and the application of amnesty. The aim of this article was to identify the main contributions of amnesty for crimes against humanity and to assess their implications for access to justice. To this end, a scoping review was conducted in accordance with the guidelines of the PRISMA declaration and its extension PRISMA-ScR, which included the examination of a sample of 47 scientific publications. The results revealed several amnesties created under a variety of terms, as well as a growing trend towards restricting their legal effects. The relationship between amnesty and justice was highlighted as debatable, since it involves evaluating, on the one hand, the interests of the victims, the context in which amnesty is approved and the interests that oppose justice; and on the other, the international obligation to investigate, prosecute and punish serious human rights violations. | ||

Las soluciones oscilan entre los enfoques de justicia y la aplicación de amnistías. El objetivo de este artículo fue identificar los principales aportes sobre las amnistías por crímenes de lesa humanidad y evaluar sus implicancias en el acceso a la justicia. Para ello, se realizó una revisión exploratoria de acuerdo con las pautas de la declaración PRISMA y su extensión PRISMA-ScR, que incluyó el examen de una muestra de 47 publicaciones científicas. Los resultados visibilizaron diversas amnistías creadas bajo una variedad de términos, así como una creciente tendencia hacia la restricción de sus efectos jurídicos. Se destacó como discutible la relación entre las amnistías y la justicia, ya que implica evaluar, por un lado, los intereses de las víctimas, el contexto en que las amnistías son aprobadas y los intereses que se contraponen a la justicia; y, por otro, la obligación internacional de investigar, juzgar y sancionar graves violaciones a los derechos humanos. | ||
