There are no specific legislations that create provisions for alternatives to sentencing, (except for children under the Juvenile Justice Act of 2015), these have only been passed out by courts using their discretionary powers. Given the colonial influence in India's history, it is relevant to introduce the readers to the developments around probation services in the pre-independence era. It is also important to observe the evolution of correctional services since India gained independence and discuss the passing of the Probation of Offenders Act (1958). Currently, there is limited yet growing knowledge on the use and impact of probation. Increased attention and efforts to revive probation in India and effective community sentencing measures will address issues of overcrowding in prisons and promote rehabilitation of remanded and incarcerated persons.
