| Sumario: | Ethics are the very foundation of the criminal justice system. Ethical guidelines are important in the criminal justice machinery as they govern the behavior of law enforcement officers, impact on their decision-making processes and understanding of the law. To ensure this, specific behavioral expectations are put forward in the form of Codes of Conduct. Codes of Conduct and Ethics are not unique to the police domain, but they are also an integral part of the entire justice system of a country. Codes and ethics of this nature stand as a preface to the mission and commitment law enforcement agencies make to the public they serve. In South Africa, very specific laws and Codes of Ethics guide members of the justice system. After democratization in 1994, many changes occurred in terms of criminal justice in South Africa. Very detailed codes of conduct and ethical principles were tabled with noble intent. The aspiration was that the different departments in the justice system will adhere to these expectations and act accordingly. Unfortunately, criminal justice in South Africa is plagued with unethical behavior and other challenges including corruption. In this contribution, we take a closer look at the expectations that are set as benchmarks in each of the sections of the justice system (e.g., police, courts, and corrections) and the challenges that occur in the different sections in terms of unethical behavior. |
