| 520 | |a Los inevitables menoscabos de la integridad corporal del paciente, o la afectación de su salud, que implican las intervenciones quirúrgicas, son indudablemente lesiones y realizan en principio el tipo de lesiones. Esto rige tanto para las intervenciones quirúrgicas consentidas, como para las no consentidas, y con independencia de que el resultado de la intervención haya sido positivo o favorable para el paciente, o, por el contrario, fallido. La responsabilidad penal del médico por dichas lesiones es, sin embargo, generalmente excepcional, salvo en determinados casos. Para determinar el fundamento de la exclusión de responsabilidad o, por el contrario, su afirmación, se analizan aquí los siguientes grupos de casos. Por una parte, las intervenciones quirúrgicas (curativas y satisfactivas o estéticas) practicadas con el consentimiento del paciente. Por otra, las realizadas sin dicho consentimiento. Y dentro de cada grupo se distingue, a su vez, entre intervenciones quirúrgicas con resultado positivo y con resultado fallido. Asimismo, se hace referencia a los casos de intervenciones quirúrgicas practicadas por quien carece de la titulación legalmente exigida para ello. | ||

The doctor´s criminal liability for such injuries is, however, generally exceptional, except in certain cases. To determine the basis for the exclusion of liability or, on the contrary, its assertion, the following groups of cases are analyzed here. On the one hand, surgical interventions (curative and satisfactory or aesthetic) performed with the consent of the patient. On the other, those carried out without said consent. And within each group, a distinction is made, in turn, between surgical interventions with positive results and those with unsuccessful results.
