AB La LO 1/2019 ha modificado el delito de tráfico de órganos, reformulando las conductas típicas e introduciendo otras nuevas, que hacen más compleja la determinación del bien jurídico protegido con la inclusión de los órganos de fallecidos y la referencia típica a las víctimas en los tipos agravados. Este trabajo se dedica a ésta y otras cuestiones interpretativas, en el que se concluye no solo que el donante no puede ser sujeto activo del delito, sino que además la tutela penal se ha decantado de su lado.
AB This work tackles several questions arising from the LO 1/2019 regarding the crime of organ trafficking. The Law has introduced new behaviors and it has modified the former crimes. As a result of these amendments the determination of the legal interest protected is even more complex. On the one hand, because the amendment has included the concept “organs of the deceased donors”. On the other hand, because the draft has added a reference to the victims in the previous aggravated behavior. One of the main conclusions to be drawn from the analysis of the amendments is that the donor cannot be considered criminal perpetrator anymore but also that the criminal protection has opted for his side.
