AB La sociedad actual es una sociedad tecnológica. Su principal componente es el constante y ubicuo riesgo tecnológico, que afecta directamente a la dimensión decisoria y conductual de las personas, en especial ante el uso automatizado y masivo de la tecnología. Muchos de estos comportamientos automatizados se encuentran amparados bajo la figura de la adecuación social, pero también los hay de los simplemente tolerados, que, aunque resultan inútiles socialmente, no obstante carecen de relevante dañosidad social y por tal razón resultan permitidos. El objetivo de este trabajo es analizar algunos conceptos que acompañan a estas nuevas habituaciones sociales al riesgo (como el de tecnología autónoma y persona autómata) para averiguar el papel que le toca al Derecho penal frente a este fenómeno.
AB Today´s society is a technological society. Its main component is the ubiquitous technological risk, which affects the dimensions of human behavior, especially in the face of automated and massive use of technology. Many of these automated behaviors are protected under the figure of social adequacy, but there are also those that are simply tolerated. The purpose of this paper is to analyze some concepts that accompany these new social habituations to risk (such as autonomous technology and automaton person) to find out the role of criminal Law in the face of this phenomenon.
