AB El delito de impago de prestaciones económicas a favor del (ex)cónyuge o de los descendientes y los delitos de insolvencia pueden producirse conjuntamente con frecuencia y, puesto que afectan a bienes jurídicos distintos, dar lugar a un concurso de delitos. Pero en el caso de las prestaciones a favor de los descendientes, si al delito de insolvencia le fuera aplicable la excusa absolutoria de parentesco, al no responderse de este, desaparecería ipso facto tal relación concursal. Ahora bien, el ámbito de aplicación ex lege de esta excusa viene determinado por el concepto de “delito patrimonial”, de interpretación no unívoca. En el presente artículo se intenta fundamentar que a los delitos de insolvencia no le es aplicable la excusa absolutoria, en razón de su naturaleza de delitos contra el funcionamiento del sistema económico, y no meramente patrimoniales.
AB The crime of non-payment of financial benefits in favor of the (ex)spouse or descendants and the crimes of insolvency can occur often jointly and, since they affect different legal interests, lead to a concurrence of offences. But in the modality of benefits in favor of descendants, if the excuse of kinship were applicable to the crime of insolvency, since there would not be no responsability for this crime, such punishable bankruptcy would ipso facto disappear. However, the area of application of this excuse is determined ex lege by the concept of "patrimonial crime", of non-unambiguous interpretation. This paper attempts to establish that the excuse or kinship is not applicable to insolvency crimes, due to their nature of crimes against the functioning of the economic system, and not merely patrimonial.
