AB Der Beitrag behandelt aus Anlass des Gesetzentwurfs der FDP-Fraktion zur Modernisierung des Strafrechts Grundprobleme der Entkriminalisierung. Dazu klärt er Begriff und Arten der Entkriminalisierung, diskutiert Gründe für Entkriminalisierung und würdigt zentrale Vorschläge des Gesetzentwurfs. Der Autor plädiert dafür, Entkriminalisierung nicht nur als ein Thema liberaler, vielmehr als Desiderat einer jeden rationalen Kriminalpolitik aufzufassen.
AB On the occasion of the FDP parliamentary group's draft law on the modernization of criminal law, this article deals with the basic problems of decriminalization. To this end, it clarifies the concept and types of decriminalization, discusses the reasons for decriminalization and acknowledges key proposals of the draft bill. The author argues that decriminalization should not only be seen as an issue of liberal politics, but rather as a desideratum of any rational criminal policy.
