AB Im Rahmen des Schwerpunktthemas „Kriminalisierung“ widmet sich der vorliegende Beitrag der Frage, inwiefern die Inanspruchnahme von Rechten im Gefängnis durch Gefangene in Konfliktfällen mit dem Gefängnis in der Rechtswirklichkeit des Strafvollzugs als abweichendes Verhalten markiert und ggf. sanktioniert wird. Dabei sollen zunächst Bedeutung und Ambivalenz des effektiven Rechtsschutzes im Strafvollzug aus rechtlicher und rechtswirklicher Perspektive beleuchtet werden, um im Anschluss zur Ausgangsfrage sowohl empirische Befunde aus einem internationalen Forschungsprojekt zum Themenfeld mit dem Titel „Prisons: the rule of law, accountability and rights (PRILA)“ als auch anekdotische Erfahrungen aus mehrjähriger Projektarbeit zum Themenfeld im Berliner Strafvollzug („Recht verständlich, „Uni im Vollzug“) zu präsentieren. Abschließend werden durch den Rückgriff auf strafvollzugstheoretische Blickwinkel Erklärungsansätze zu unseren zentralen Befunden präsentiert.
AB This paper explores the extent to which prisoners who claim their rights in cases of conflict within the prison setting are subject to criminalisation or sanctioning. It examines the significance of effective legal protection  in the prison system from a legal and sociological perspective before presenting empirical findings.These stem from an international research project titled “Prisons: The Rule of Law, Accountability and Rights (PRILA)” as well as experiences from several years of project work in the Berlin prison system (“Recht verständlich”, “Uni im Vollzug”). Finally, by drawing on perspectives from prison theory, the paper discusses key findings.
