Sumario:Der Artikel untersucht den Ausnahmezustand als rechtssoziologische Analysekategorie. Die Autorin übt dabei eine Kritik an rechtswissenschaftlichen Veröffentlichungen, die die Ausnahme vom Recht als verallgemeinerbares rechtssoziologisches Strukturmerkmal in der Kriminologie fassen versuchen, ohne deren normative Implikationen zu beachten.
The article examines the state of emergency as a sociological analysis category. The author criticizes jurisprudential publications that define the exception to law as a generalizable structural feature of legal sociology in criminology without considering its normative implications.
