AB Se revisan críticamente las tesis sostenidas en el libro de Fernando Miró Llinares objeto de recensión. Se cuestiona que sea posible proporcionar una interpretación global de la historia de la dogmática penal. A cambio, se propone que se profundice en el estudio historiográfico científico de su evolución, que esté atenta a sus causas y consecuencias políticas, sociales y culturales. Finalmente, se examina la cuestión de si existe verdaderamente un progreso en el conocimiento dogmático, poniendo en cuestión las interpretaciones progresivas (whiggish) de dicha historia.
AB The content of the book by Fernando Miró Llinares is critically reviewed. It is discussed whether it is possible to provide a global interpretation of the history of criminal legal theory. In return, it is proposed that the scientific historiographical study of its evolution be deepened, that it be attentive to its causes and political, social and cultural consequences. Finally, the question of whether there really is progress in jurisprudential knowledge is examined, discussing the whiggish interpretation of such history.
