En el estudio se abordan los distintos problemas interpretativos que pueden plantearse en su aplicación. El trabajo se estructura en cuatro partes. En la primera, llevo a cabo un repaso por su devenir legislativo hasta su redacción actual, con un primer acercamiento a la cuestión de la relación concursal con los delitos autónomos de pertenencia a organización y grupo criminal contenidos en los arts. 570 bis y 570 ter, pues fue el principal problema puesto de manifiesto entonces. En la segunda parte se estudian las organizaciones y los grupos criminales como premisa de la agravación y, en la tercera, los distintos elementos que acotan su ámbito típico y el fundamento de la propia circunstancia. Finalmente, en la cuarta parte se abordan más a fondo los problemas concursales, así como las diversas fórmulas agravatorias por pertenencia a agrupaciones criminales. | ||
| 520 | |a This research work analyzes the hyperqualification of the murder consisting of the crime being committed by someone belonging to a criminal group or organization. The study addresses the different interpretive problems that may arise in its application. The work is structured in four parts. In the first, I carry out a review of its legislative evolution up to its current wording, addressing the bankruptcy relationship with the autonomous crimes of belonging to an organization and criminal group contained in the arts. 570 bis and 570 ter, as it was the main problem revealed then. In the second part, criminal organizations and groups are studied as a premise of aggravation. In the third, the different elements that delimit its typical scope and the foundation of the circum- stance itself. Finally, in the fourth part, the cases in which the death is related to other activities that facilitate or ensure the main activity of the group are analyzed, that is, the relationship of the hyper-aggravated murder with the end crime of the organized structure. | ||
