Se entiende por cláusula concursal de compatibilidad aquella previsión expresamente prevista que da entrada a dos o más preceptos; son situaciones de concurso de delitos. Existen hasta 67 cláusulas concursales de compatibilidad en el código penal español vigente (2022): algunas, previstas desde el texto originario (1995); y otras, introducidas con posterioridad. Se clasifican según la lógica concursal que plasman (real, medial o ideal), el ámbito de concurso (compatibilidad abstracta o concreta), y el modo de prever su eficacia (aplicación prescriptiva o potestativa). La inmensa mayoría de estas cláusulas no tienen más eficacia que la de servir de alerta al intérprete para valorar el desvalor completo de la conducta (y, por eso, son calificadas como «débiles»). Pero hay algunas de ellas (14, calificadas como «fuertes») cuya vigencia es preceptiva y concreta, y vendrían a reinstaurar complejos delictivos al margen de las reglas concursales generales. | ||

A «compatibility joinder clause» should be understood as an expressly provided clause that gives rise to applying two or more precepts, being nothing but situations of concurrence/joinder of offences. There are up to 67 «compatibility joinder clauses» in the Spanish criminal code (2022): some provided from the original text (1995) and others introduced later by several Acts. They are classified accordingly to the concurrent logic they embody (i.e., real, medial, or ideal [under Spanish Criminal Dogmatik]), the scope of the concurrency (abstract or concrete compatibility), and the way of anticipating its effectiveness (mandatorily or optional). Most of such clauses have no more strength than serving as an alert to assess the complete wrongdoing of the conduct (and, therefore, they are classified as «weak»). But there are some of them (14, qualified as «strong») whose validity is concrete and mandatory and would reinstate «criminal complexes» (i.e., the application of both penalties) despite what the general regime of concurrent offences or sentences may state. | ||
