| 520 | |a The Internet is usually linked to strongly visual technological expressions. The spectacular nature of the new multimedia expression, supported today by technological artifices previously inconceivable, makes us forget that very often this visual display is oriented to the service of textual discourse. The victimization of speech today fills the Internet with a hurtful and radicalized verbalism, where words kill, steal the spirit and identity of users and disruptively break the communication of the virtual environment. Very often, this harmful language exploits the expressive field of play and free recreational praxis, inducing an incessant virtual noise where victims blur and self-silence their grievances. This is the premise that animates the present analysis where we assume the concern for the victimizing toxicity of e-language. From the foundations of normative improvement, we approach Austin’s speech act theory in the light of functionalist legal-criminal dogmatics. Our application offers us relevant nuances, such as communicative adequacy, the distinction between person and individual, the overcoming of the ontological substrate of crime and the normativization of action and imputation. We do not forget, however, that these are tools: the complex rationality of the normative edifice has its ultimate justification in the priorities of a complex society, among which the security and indemnity of users is inexcusable. | ||

La espectacularidad de la nueva expresión multimediada, apoyada hoy por artificios tecnológicos antes inconcebibles, pone en olvido que muy a menudo ese despliegue visual se orienta al servicio del discurso textual. La victimización de habla colma hoy Internet con una verbalidad hiriente y radicalizada, donde las palabras matan, roban el espíritu e identidad de los usuarios y quebrantan disruptivamente la comunicación del entorno virtual. Muy a menudo, este lenguaje dañino parasita el campo expresivo del juego y de la libre praxis recreativa induciendo a un ruido virtual incesante donde las víctimas se desdibujan y auto-silencian sus agravios. Esta es la premisa que anima el presente análisis donde asumimos la preocupación por la toxicidad victimizante del e-lenguaje. Desde fundamentos de mejora normativa, abordamos la teoría de los actos de habla de Austin a la luz de la Dogmática jurídico-penal funcionalista. Nuestra aplicación nos ofrece matices relevantes, tales como la idoneidad comunicativa, la distinción entre persona e individuo, la superación del substrato ontológico del delito y la normativización de la acción y de la imputación. No olvidamos, sin embargo que se trata de herramientas: la compleja racionalidad del edificio normativo tiene su justificación última en servir a las prioridades una sociedad compleja, entre las cuales la seguridad e indemnidad de los usuarios resulta inexcusable. | ||
