AB En este trabajo se analizan los diversos fundamentos del riesgo permitido: utilidad social, ponderación de intereses y la legitimación histórica. Posteriormente, se tiene como punto de partida metodológico que, de acuerdo con división de poderes, la función interpretativa del derecho solo les corres-ponde a los jueces; así mismo, que la pregunta por el fundamento de los con­ceptos jurídicos tiene importancia secundaria para la aplicación válida de las reglas jurídicas. De este modo, se proponen críticas a cada uno de los funda­mentos del riesgo permitido. Finalmente, se concluye que el problema que se pretende solucionar pertenece a la aplicación de normas; es necesario un estudio específico del problema y la revisión del estado actual del riesgo permitido.
AB The following article analyzes the variety of foundations of allowed risk, in particular: social utility, weighting of interests and historical legitima­tion. Subsequently, the methodological starting point is that, in accordance with the division of powers, the interpretative function of the law corresponds to the judges. Likewise, the foundation of legal concepts is of secondary importance for the valid application of legal rules. In this way, critics are proposed for each of foundations. Finally, it is concluded that the problem belongs to the application of norms. Therefore, a specific study of the problem is necessary and the inspection of status of allowed risk.
