| 520 | |a Los primeros estudios sobre tipologías victimales fueron el origen de dos corrientes que han tenido una repercusión doctrinal, legislativa y jurisprudencial absolutamente dispar. Por un lado, dieron lugar a teorías victimodogmáticas que, por lo general, han defendido la aminoración (e incluso exención) de responsabilidad criminal con base en la contribución de la víctima al delito. Por otro lado, surgió la necesidad de perfeccionar las investigaciones acerca de la predisposición o vulnerabilidad victimal, que, en ocasiones, han servido para fundamentar agravaciones penológicas. En el presente trabajo, tras narrar el recorrido de ambas tendencias hasta la actualidad, se analiza, concretamente, su repercusión en el Derecho penal español. La conclusión alcanzada es que la victimodogmática tradicional, a pesar de la buena acogida que tuvo en sus inicios, estaría actualmente en desuso. Por el contrario, las ideologías victimagógicas basadas en la vulnerabilidad victimal se expanden vertiginosamente, aunque no hayan conseguido el respaldo de la academia victimológica ni jurídico-penal. Sentado lo anterior, se propone una ampliación de las fronteras de la victimodogmática y la incorporación de algunos de sus nuevos postulados a la legislación penal. | ||
| 520 | |a The first studies on victimization typologies were the origin of two trends that have had disparate doctrinal, legislative and jurisprudential impact. On the one hand, they gave rise to a victim- dogmatic that, in general, has defended the reduction (and even exemption) of criminal liability based on the victim’s contribution to the crime. On the other hand, there was a need for further research into predisposition or vulnerability to victimization, which has sometimes been used to justify penal aggravations. In this paper, after describing the history of both approaches to the present, we specifically analyse their impact on Spanish criminal law. The conclusion reached is that the victim-dogmatic theory, as we know it, though initially well received, now seems to be in disuse. On the contrary, victimagogic ideologies based on the victim’s vulnerability are gaining momentum, although they have not obtained the support of the victimology and criminal law academia. Having established the above, it is proposed to broaden the boundaries of victim-dogmatic theory and the incorporation of some of its new postulates into criminal law. | ||
