Even so, on European agreement, each EU Member State has adopted a different policy, criminalising either the sexual exploitation of others or the client (Nordic model), or criminalising human trafficking in terms of sexual exploitation, depending on the legal description of the crime and the legal assets to be protected. In Portugal, prostitution has gone through moments of legalisation and prohibition, and has remained decriminalised since 1982, despite successive intersections with the statute relating to the crime of pimping. Considering how understanding about prostitution has evolved and the blurred boundaries between the different types of pimping and human trafficking crimes, the present chapter aims to question the current configuration of para 1 of Article 169 of the Penal Code, which incriminates only pimping. | ||
