AB El presente texto busca analizar cómo se sancionan el feminicidio y el transfeminicido en la legislación penal colombiana, a través del artículo 104-A del Código Penal colombiano. Para ello se hace, en primer lugar, un esfuerzo por dotar de contenido los elementos subjetivos que contiene el tipo penal. Al dotar de contenido los elementos subjetivos no solo se comprende en qué consisten las conductas sancionadas, sino que estas se pueden diferenciar entre sí y de otras manifestaciones de violencia de género. Por último, se expli­ca la importancia y la necesidad de tener en cuenta los contextos generales y específicos en los que suelen tener lugar los feminicidios y transfeminicidios, necesidad que fundamenta el listado de circunstancias contextuales contenidas en el artículo 104-A del Código Penal colombiano.
AB This article seeks to analyze how femicide and trans femicide are punished in Colombian criminal legislation through article 104-A of the Co­lombian Criminal Code. To do so, an effort is firstly made to give content to the subjective elements contained in the criminal offence. By giving content to the subjective elements, not only is it possible to understand what the pun­ishable conduct consists of, but also to differentiate between them and from other forms of gender-based violence. Finally, it explains the importance and the need to consider the general and specific contexts in which femicides and trans femicides tend to take place. This need underlies the contextual circumstances in article 104-A of the Colombian Criminal Code.
